That is historically quite incorrect. All parts of France except Alsace-Lorraine remained under the rule of the legal French Government, which had moved its seat to Vichy.....the Northern occupied zone was under german direct rule and the southern "free" zone was controled by Pétain's regime under indirect german rule......
The Armistice Agreement gave the German military authorities specific rights in the Occupied Zone required for the operations of the German armed forces in prosecuting the continuing war against Britain, and for maintaining the security of those forces. However, the German military authorities had no power over the French civilian population, except for the maintenance of the security of German personnel, and if they wanted to take any action against French civilians they needed to seek the permission of the French Government. The Germans authorities only had the right to arrest French civilians who threatened the security of German personnel.
French prefects remained the source of governmental authority throughout the Occupied Zone, and were not legally obliged to take instructions from the German military authorities, unless instructed to do so by the French Government in Vichy.
An example is provided by the actions of Maurice Papon, the Sub-Prefect in Bordeaux, when asked by the German police authorities to arrest Jews for deportation. Papon first referred to the French Police Chief in Paris, Jean Leguay, to determine whether the German request had been agreed to by the French Government. He only carried out the arrests after being instructed to do so by Leguay.

Thanks for the correction kstdk,
I didn't see a breast pocket Adler so I thought maybe it was SS. Looking again I now see a Luftwaffe Adler on the pennant.
