In 1973 Buchs and an unidentified other were sentenced at Wuppertal for crimes committed in Bialystok in 1941. The trial reference is here: http://www1.jur.uva.nl/junsv/brd/brdeng ... eng792.htm

I have a couple of questions. Firstly, is there a detailed judgment available on-line? Secondly, why were these two defendants convicted but not other members of the battalion, such as Friedrich Rond, who were tried in these earlier proceedings? http://www1.jur.uva.nl/junsv/brd/brdeng ... eng664.htm

Rond is not mentioned in the trial you mention because he had already gone to trial, the first PB 309.
Use the same JuNSV thread with trial 664. His particular case was discontinued "Verfahren eingestellt";
maybe he was too old old or ill or died.

The charges at both trials were more or less the same.

Hello

a little clarification: the name of the man in question is not Frierich Rond, but Friedrich Rondholz. :wink: In JuNSV, his name has been "obscured" (Rond.).

Rondholz was tried again in 1977 and acquitted of murdering four Soviet POW's:

Does anyone have information about Major Ernst Weis, who commanded Battalion 309, and who, according to Goldhagen, was cited in the Buchs trial as having issued a pre-Barbarossa extermination order for all Jews captured by the unit? Weis does not seem to have appeared in person at any West German war crimes trial, as witness or defendant.

Here is what I have on the men of the battalion. The trial info is available only from a handful of libraries. I think you can buy them from the publisher in Holland.

Police Battalion 309

This battalion was formed using personnel from the Cologne area on September 19, 1940. It was a three company battalion with one heavy machine gun platoon.
Field Post Number(s): 45785
Commanding Officer: Major/LTC. Ernest Weis (1939 to 1942), Major Bruckner (1942 to ?) 1
Other Officer(s): 1st Company: Captain Hans Behrens. He was awarded the Iron Cross 2nd class for his actions in Bialystok on July 11, 1941. Captain Behrens was a member of the FreeCorps (right wing paramilitary) and then the police during the Weimar Republic. After the war he continued being a policeman and in 1951 was an instructor at the police school in Kiel. He retired in 1955 with a full pension. 2
2nd Company: 1st Lieutenant Johann Hoehl
3rd Company: 1st Lieutenant Rolf Joachim Buchs. He was awarded the Iron Cross 2nd class for his actions in Bialystok on July 11, 1941. Lieutenant Buchs joined the SS in 1934. He continued working for the police after the war and in the 1950’s was chief of police in Solingen. After a trial in 1968 he received a four year sentence for his war crimes.
3rd company, 4th Platoon Leader,: Lieutenant Heinrich Schneider was awarded the Iron Cross 2nd class for his actions in Bialystok on July 11, 1941. He received a pension after the war and worked for the firm of Villbrandt & Zander AG in Wuppertal as a work leader. 3rd Company, Top Sergeant was Georg Schwarz. Sergeant Schwarz continued working for the police and in 1967 was a police Hauptmeister in Neuss.
Other personnel: Captain Winkler. His position in the battalion was not mentioned but he was wounded near Stare Darobi on August 30, 1941. R18
The battalion formed the I/Police Regiment 7 in July 1942.

Einsatzgruppen/Atrocity Activity
June 27, 1941: Bialystok, Poland with the 221st Security Division. The 1st and 3rd Company of this battalion helped burn over 700 Jews alive inside a synagogue. They assisted in killing 2,000 to 2,200 Jews in Bialystok. Einsatzkommando 9 was also active in these actions with them. 3

Weis was also C.O. of PB 65 for 3 months in 1939. In May 1944 he was the commanding officer of SS Police Regiment 15 in Italy.

Weis was the head defendant when investigations against Pol Batt 309 started.
The case was later closed against Weis .
