On 1940 following the invasion. The Departement of Moselle became the Zivilverwaltung Lothringen then incorporated into Reichsgau Westmark. From 1942 to 1942 90 % of inhabitants not expelled were considered as "Lothringer" (Lorrains) not Germans.
After 1942, they became revocable germans for the duration of war to allow enlistment.

Any way from 1940 the inhabitants of Lorraine which remain to preserve their job, their farm, their home, their roots who join (non armed) resistance networks were sentenced as traitors not as partisans.

21 membres of the early movement "l'espoir français" (Young people form 16 to 22 years old) were sentenced by the 4th chamber of Volksgerichtshof at Zweibrücken on 42. 10 where sentenced to death but Gauleiter Bürckel didn't want to make them martyrs at a period of enlistement of Young lorrains was decided.

This question was the same in Alsace which was too annexed "de facto" never "de jure".
