That is a very nice photo. Later promoted SA-Obergruppenführer. He was Ministerpräsident of Württemberg and a bitter rival of the Gauleiter & Reichsstatthalter, Wilhelm Murr (whom he judged, correctly, to be far-less educated). A great and readable account of life in Land Württemberg / Gau Württemberg-Hohenzollern, with details on the Mergenthaler vs. Murr feud is Jill Stephenson's Hitler's Home Front: Württemberg Under the Nazis(Hambledon Continuum, 2006).

Although his biography appears in Höffkes' Hitlers Politische Generale (in which he is given as a Gauleiter of Württemberg-Hohenzollern), I can find no corroboration that he ever held a gauleitership- even in a temporary or acting capacity.

in the book "Männer im Dritten Reich" the bio of Mergenthaler give the following infos :
during NSDAP was forbidden, he was Gauleiter der NS Freiheitsbewegung in Wurttemberg in 1924.
